This week in a New York court attorney's for EMI made the argument about why I should be personally liable as CEO of MP3tunes. They are suing not only
MP3tunes, but also me personally and are going after my home, cars and kids college funds in their suit. I'm fighting back because it's wrong to go
after someone simply because they are the CEO and MP3tunes is not about piracy. We let people listen to their own music collection (not others). Unlike most
others online, we are strict about not sharing music between Lockers. I'm not alone in having to personally face the attacks of music attorneys. Besides
misguided suits against end users the labels are personally suing other CEOs in a calculated strategy to try and intimidate company executives and investors
from doing digital music start-ups.

There doesn't seem to be any depth that these music industry dinosaurs aren't willing to plumb.
I look forward to the suit getting thrown out. Any Judge with a backbone would. And if the judge finds any malicious intent in their actions then maybe you should bring a personal action against the boards of the legal company and the music company for such. Keep up the good fight Michael!

With their tactics EMI and all the record companies can kiss my a** goodbye. They will not ever see another cent of my money as long as they keep up this
harrasment. I hope they lose big and for a long time. They are not doing themselves any favours and probably hurting the musicians the most.

I remember when microsoft pursued you over Lindows...all around the world... EMI might use a similar strategy ...
you might want to publish email addresses and contact info for EMI and start a public petition...inundate legislators and other parties.If EMI's lawyers had phone calls from people complaining to them EMI night have a change of heart...I suspect they don't need that kind of publicity. And if EMI's artists hear of a grassroots campaign against EMI, they might back off... |

What about antitrust and restrint of trade | ||

Has anyone thought of filing an antitrust suit or a restraint of trade suit against EMI AND their lawyers???!!! It seems to me that they are simply trying to
restrain trade and create a monopoly using the courts to do it. Please remember, the artists are making little or no money from record sales.
They make their money from concerts and many of them won't sign with record companies any more because they can get the equipment and build their own studios to create their own recordings. They also sell direct to the consumer. So, we the consumer have nothing to gain from buying from the big record companies. In fact we consumers have everything to gain from buying direct from the artist. |

Short term suggestion: Find an indigent (street person) who, for a modest fee, will function as "titular CEO", (Someone living in a shelter would be
a nice choice). And then arrange for some private (secret ) agreements that give you power of attorney (if you can), so that you or a nom-de-plume can exercise
executive decisions "in the indigent's name (on behalf of the corporation), and let the Big Boys try to get blood out of a turnip.

I am not a user of MP3 tunes. Nor do I download music in any form. EMI is absolutely out of control. I am a content provider (Music, Videos, and material). So
I make content. Not a member of EMI. I would be ashamed to be affiliated to the EMI and any of thier henchmen. This is not the way to solve this problem (What
Problem?). Just like as of late that some of these bizarre litigations and judgements come down and they try to set some precident. You are out there trying
to make a living and what do these people really do? It reminds me of the "Gangs of New York" trying to squeeze as much out of something until they
give in or get killed.
I hope this does not do that to you. Keep in there. I want to see mud on thier face. I do like the "A Tactic as Low as Your Opponent" scheme...... Best Regards, Z |

I can't wait for dinosaur companies living in the past like EMI to become extinct. The music in my locker is music I own and other than sell it or share it
I can do what the heck I want with it! EMI should focus their efforts on transforming their business to deal profitably with the realities of the digital world
instead of wasting resources on trying to keep living in the past. Adapt or die!

The more I think about the EMI lawsuit, the less I think it really about the on-line storage locker. I think the real issue is the on-line search ability that
then moves any music you like into your locker. Since some of the music from searches may later be removed due to a take-down notice, that means that the
lockers are now providing storage for questionable songs. I think that it is the search-n-store capability that is the target.
That doesn't make the EMI suit "right" by any means, but I at least see why that search and retrieve tool would seem more objectionable than the passive role of simply providing the music locker storage and acess. And I'm still more than puzzled why the court filings have not been linked to these pages so everyone could read it for themselves rather than leaving us to speculate based upon the sporadic reporting about the lawsuit. |
